Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and AIFont Ltd. ("AIFont", "we") regarding your use of the AIFont website and service (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.
2. Accounts
- Provide accurate registration information and keep it current.
- You are responsible for activity under your account and for keeping your password confidential.
- One person or organization per account. Automated, bulk or shared account creation is not permitted.
- We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.
3. Your license to use the Service
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal and commercial design purposes, in accordance with your plan limits. All rights not expressly granted are reserved by AIFont.
4. Generated fonts and commercial licenses
- Every font you generate is rendered by our engine as an original vector typeface.
- Issuing a license creates a perpetual, non-exclusive, worldwide, non-transferable commercial license for that specific typeface to you. The License Agreement is incorporated by reference.
- A license covers unlimited end products for you and your clients. It does not permit redistribution, resale or sublicensing of the raw font files.
- You are responsible for reviewing any font before using it. We do not guarantee that a generated font is free of third-party rights or suitable for a trademark filing. We strongly recommend professional legal review before registering any typeface as a trademark.
5. Acceptable use
You agree not to use the Service in violation of our Acceptable Use Policy, which is incorporated by reference. Violations may result in immediate suspension, loss of credits, and termination without refund where the violation is serious.
6. Plans, credits and billing
- The free plan includes a monthly allowance of generations. Credits refresh at the start of each calendar month and do not roll over.
- Paid plans are billed in advance through our payment processor. Prices are shown in USD and may change with 30 days' notice.
- You may cancel a paid plan at any time from billing settings. Access continues until the end of the period you have already paid for; we do not pro-rate partial periods except where required by law.
- VAT or sales tax may be added where required by law and will be shown before payment.
- Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Intellectual property
- Our IP: the Service, software, engine, algorithms, interface, design, trademarks and documentation are owned by AIFont or our licensors.
- Your content: you retain all rights to the descriptions you submit. You grant us a limited licence to host, process and display that content solely to operate the Service.
- Generated fonts: we grant you the commercial license described in section 4. Fonts remain part of our library so other users can preview and license them.
- Feedback you send us may be used to improve the Service without restriction or obligation.
8. Third-party services
The Service integrates with third-party providers, including a payment processor and a language-model provider. Their services are governed by their own terms, and we are not responsible for the availability, content or conduct of third-party services.
9. Warranties and disclaimers
Except where the law says otherwise, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, that generated fonts will be error-free, or that the Service will meet your specific requirements. Alpha-quality output should always be reviewed before commercial use.
10. Limitation of liability
To the maximum extent permitted by law, AIFont and its team are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months preceding the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, wilful misconduct, death or personal injury caused by negligence.
11. Indemnity
You agree to indemnify and hold harmless AIFont from any claim, demand, loss or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of the Acceptable Use Policy, or your infringement of any third-party right, to the extent permitted by law.
12. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately for material breach of these Terms, for non-payment, or where required by law or to protect the platform and its users. On termination, your right to use previously licensed fonts continues for the life of those licenses; rights to use the Service itself end.
13. Changes to these Terms
We may update these Terms. The "last updated" date reflects the current version. If a change is material, we will notify you by email or in the product before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
14. Termination of the Service
We may discontinue the Service or any part of it at any time. Where we terminate a paid plan other than for your breach, we will refund any prepaid, unused fees for the remaining period.
15. Governing law and disputes
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Before filing any formal proceeding, you agree to contact support@pandada.ai - most disputes are resolved quickly that way. Where the law allows, you agree to submit disputes to the exclusive jurisdiction of the competent courts at our principal place of business, and you waive any objection to venue. Nothing removes the protection of mandatory consumer rights available to you where you live.
16. Severability, waiver and assignment
If a provision is found unenforceable, the rest of these Terms remain in force. A failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them as part of a merger, acquisition or sale of substantially all assets, with notice to you.
